By downloading, installing, or using the BRAKKE mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
BRAKKE is a personal recovery journey tracking application designed to help users:
- Track recovery progress and milestones
- Maintain personal journals and reflections
- Access motivational tools and resources
- Monitor streaks and achievements
3. Medical Disclaimer
IMPORTANT: BRAKKE IS NOT A MEDICAL DEVICE OR PROFESSIONAL TREATMENT SERVICE
- The App is a self-help tool and does NOT replace professional medical treatment, therapy, or counseling
- We do not provide medical advice, diagnosis, or treatment
- Always seek professional help for addiction and mental health issues
- In case of emergency, contact emergency services immediately
- We are not liable for any decisions made based on App content
4. User Eligibility
- You must be at least 13 years old to use the App (16 in the EU)
- Users under 18 should have parental or guardian consent
- You must provide accurate information when creating an account
- You are responsible for maintaining account security
5. User Account and Responsibilities
Account Creation
- You may need to create an account to use certain features
- You are responsible for keeping your login credentials secure
- You must notify us immediately of any unauthorized access
Prohibited Activities
You agree NOT to:
- Use the App for any illegal purposes
- Attempt to hack, reverse engineer, or compromise the App
- Upload malicious code or viruses
- Harass, abuse, or harm other users
- Impersonate others or misrepresent your identity
- Share your account credentials with others
- Use automated tools or bots to access the App
6. Privacy and Data

- All content, features, and functionality are owned by BRAKKE
- This includes text, graphics, logos, icons, images, and software
- Protected by copyright, trademark, and other intellectual property laws
Your Rights
- You retain ownership of content you create (journal entries, notes, etc.)
- You grant us a limited license to store and display your content as needed to provide the service
- You can delete your content at any time
8. Subscription and Payments
If applicable:
- Some features may require a paid subscription
- Subscriptions are billed through the App Store or Google Play
- Pricing is displayed before purchase
- Subscriptions auto-renew unless cancelled
- Refunds are subject to App Store/Google Play policies
- We reserve the right to change pricing with notice
9. App Availability and Updates
- We strive for 24/7 availability but do not guarantee uninterrupted service
- We may update, modify, or discontinue features at any time
- Scheduled maintenance will be communicated when possible
- Updates may be required for continued use
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
- No warranty of merchantability or fitness for a particular purpose
- No guarantee of accuracy, completeness, or reliability
- No warranty that the App will be error-free or uninterrupted
- No guarantee of specific results from using the App
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, or consequential damages
- This includes loss of data, revenue, or profits
- Our total liability shall not exceed the amount you paid us in the past 12 months
- We are not responsible for decisions made based on App content
- We are not liable for third-party content or services
12. Indemnification
You agree to indemnify and hold BRAKKE harmless from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Your content or conduct
13. Termination
By You
- You may stop using the App at any time
- You can delete your account through the App settings
By Us
- We may suspend or terminate your access for violating these Terms
- We may discontinue the App with reasonable notice
- Upon termination, your data may be deleted per our Privacy Policy
14. Governing Law and Disputes

- Assignment: We may assign these Terms; you may not without our consent
- No Third-Party Benefits: These Terms do not create rights for third parties
